Judges Gone Wild?

Early today Girls Gone Wild founder Joe Frances turned himself into federal custody. His crime: refusal to settle a law suit. That’s right he is in jail because he refused to settle a lawsuit.

Frances is being sued in federal court by seven women who appeared in his videos. U.S. District Judge Richard Smoak ordered Frances to settle the suit or be found in contempt of court. The settlement negotiations failed, and the Judge found him in contempt and ordered his arrest.

Can the judge do this legally? Of course not. It is a violation of both Frances’ due process rights protected by fifth amendment and his trial rights ensured by the Eight Amendment. So why is Frances in jail today? He is in jail because a judge is abusing his authority and the Eleventh Circuit is letting him get away with it.

Did John Kerry Act Improperly

President Bush had to use a recess appointment because Senator Kerry has thwarted Fox's nomination because Fox contributed money to the Swift Boat Veterans. We all know that the media will focus on the propriety of Bush's appointment even though it is a well established precedent that the President has this power. The question the press should be asking is whether it is proper for a Senator to block a nomination because the nominee donated money to a political opponent. Is this the proper use of a Senator's office? I don't think the question will come up. Unless of course a Republican tried to do it.

Manufacturing Scandal: Part Three

Now that the Democrats have taken control of Congress they are in full strength investigation mode. The problem for them is that this administration has not done anything wrong. So what do the Democrats do? They make up scandals. First was the so called US Attorneys scandal. Despite the fact that the President acted within his constitutional authority and there is NO evidence of any improprieties, this has been the lead story for weeks.

Now the Democrats are setting their sights on President Bush’s recess appointment of Sam Fox to be Ambassador to the Netherlands. Mr. Fox was nominated but he ran into trouble in the Senate. It seems that he contributed money to the Swift Boat Veterans and John Kerry was none to pleased. So Kerry used is influence to thwart Fox’s confirmation. When Congress went into Easter recess President Bush took the opportunity to make a recess appointment of Fox.

Now the Democrats are claiming that Bush acted illegally in the recess appointment and are calling for an investigation. The problem for the Democrats is that there is a long tradition for presidents making recess appointments. If the Fox case sounds familiar it is because a very similar thing happened in the Clinton administration. Clinton nominated James Hormel to be Ambassador to Luxembourg. Republicans thwarted his nomination because they were concerned that he was an outspoken homosexual. Clinton responded by making a recess appointment of Hormel.

Will the Democrats get away with attacking Bush for using what has become a well established presidential power? Will the press again treat this as if it is a legitimate scandal? Time will tell.

SanFran Nan and Her Terrorist Friends

It is highly unusual for high ranking congressional officials to travel to enemy states when the State Department has asked them not to. The reason is that it is important for the United States to have unity of foreign policy. Because the President is constitutionally charged with foreign policy Congressmen usually defer when asked.

So why has Nancy Pelosi traveled to Syria to have a photo op with one of the greatest sponsors of terrorism around the world? You have probably heard the old saying “my enemy’s enemy is my friend.” I think that is the case here. Syria hates Bush because he is fighting its terrorist friends around the world. Pelosi hates bush because he is standing in the way of Democratic dominance.

It is important to look at the motives for both. Syria wants the Pelosi visit so it can have the picture of the United States Speaker of the House meeting with President Assad. They hope this will increase the legitimacy of Syria around the world at the same time defusing the effectiveness of the Bush administration. This is important because the Bush administration has been successful in isolating the terrorist sponsoring state. Syria hopes this visit will strengthen its position in the world. A stronger Syria means a more terrorism.

Pelosi also wants to use the visit to weaken the Bush administration. She is hoping that by making high profile visits to countries like Syria she can inject herself into the arena of foreign policy and limit Bush’s ability to achieve his foreign policy goals. But to achieve her goals, Pelosi needs to simultaneously aid Syria in it terrorist agenda. It seems to me that Pelosi is pushing her own agenda at the expense of aiding world terrorism. That is truly appalling behavior.
